It's called the "sporter clause" and it's found within the 1968 GCA. It allows ATF to legislate by decree without congress if it determines a firearm of related item doesn't meets it's own qualifications for "sporting purposes" applications. It also permits them to create determination letters that in some cases are not even in compliance with their own stated definitions such as when their bumpstock ruling was not in accordance with their own definition of a "machine gun" or even a "firearm."
