Limited injunction issued on ATF pistol brace ban

Good news--the first injunction has been issued on the ATF pistol brace ban.

Bad news--it only covers the parties to the lawsuit in the 5th Circuit (apparently). It is not a nationwide injunction, yet.

I don’t see this going anywhere, & is just a small pebble in the road, but on the slight case it should pass, what happens to the thousands who filled out the free form 1? GARY.

You mean against the advice of literally everyone, who said "wait?"

Why should I care? If some dopes take the unilateral word of the ATF as gospel, before they are legally compelled to do so, who cares?

Now there were some who always planned to file anyway (they wanted a true SBR), without regard to the dictatorship of the ATF, so this was a bargain for them.

Win, win--good guys got a deal, dopes exposed themselves as dopes.

Now if there is no action by the end of the month (i.e. 1 week), then people will be compelled to file (or ditch the brace). Yay communism!!!

Pretty much my take as well. Have people forgotten that the "brace" thing was always a red flag waved at the atf to provoke them into showing their ass so they could get fucked? This new "rule" was always the expected outcome, so that "we" (gun rights groups and lawyers on our behalf) could stomp their ass in court. They threw the community off by letting it go for a time. But that proved to be a mistake on their part, due to the recent rulings of SCOTUS bolstering our already solid constitutional case.
Heller opened the door to a cavalcade of litigation, and the community charged forward to take as much ground as we can on as many fronts as possible. The end goal is the repeal of the NFA on constitutional grounds, and everything from bump stocks to FRTs, and braces to "shockwave" type "destructive device", is just another front we are advancing to show the NFA as arbitrary and make the ATF look like the clownworld tyrants they are.

I recall when the brace was first released, being urged to run out and buy as many as we could. The idea being that "common use" was already an attack vector being pushed. This was always the plan. But unlike in 2010, we now have an extremely good chance of gutting a nearly century old piece of garbage legislation (NFA of 34).

The only thing we've really learned since the new rule, is who we can't trust to fight to the end (ie anyone who complied without already wanting an SBR stamp). For those who complied, enjoy being the only clowns on the new "registry". For the rest of us, don't just hold the line, tallyho.

Wasted effort and potentially a free SBR has my guess. I don't see a huge negative to it, other than a waste of time and resources. Does it tell the ATF that we own X and X and X? Sure. But who cares? It ain't ALL we own.

So the 5th Circuit has clarified that its injunction is not a nationwide injunction, not even a circuit wide injunction:

Just as I’m 100% certain the founders of this nation never imagined modern weapons like Mac 10’s, AK’s, M16’s MP-5’s firing 1000 rounds per minute, suppressors, and fancy optics would be available to the common man. Back then if you were good you could get off three rounds per minute. GARY.

Utterly ridiculous how this is being done (and I say that as someone covered by the SAF injunction--I'm a lifetime member).
