The "legalities" don't matter. They'll bring charges, you defend yourself against the charges. Don't have the money to pay for enough due process? Then plead to something less, pay a fine. Oh, the plea on your record? It and the effects are just technicalities. The state's attorney will have another "conviction" on his/her/its record to crow about when running for another office. It's all simple. "Cliff's Notes" version, something about "We can't control innocent men," and so on.

It would be amusing, as well as instructive, to watch such an attempt. Whether to get the charges made, or a court to hear such a case, would be quite the challenge.
