Ah, but he didn't turn it over, or sell it or "transfer" it in the customary sense. It was abandoned during a hasty retreat. He can play semantics and say he didn't transfer it, and say that with a straight face. He knows what he's doing. The Army knows how it's done; probably got special orders.
