New definition of "Engaged in the Business"

Current definition explicitly excludes anyone who has a daytime job. The proposed definition would seem to require an FFL for even casual buying & selling to groom your collection, if the values increased. Per the draft Senate bill, the new definition of "engaged in the business" of selling & buying firearms is:

19 SEC. 12002. DEFINING ‘‘ENGAGED IN THE BUSINESS’’.
20 Section 921 of title 18, United States Code, is
21 amended—
22 (1) in paragraph (21)(C), by striking ‘‘with the
23 principal objective of livelihood and profit’’ and in
24 serting ‘‘to predominantly earn a profit’’;

1 (2) by redesignating paragraphs (22) through
2 (29) as paragraphs (23) through (30), respectively;
3 and
4 (3) by inserting after paragraph (21) the fol
5 lowing:
6 ‘‘(22) The term ‘to predominantly earn a profit’
7 means that the intent underlying the sale or disposition
8 of firearms is predominantly one of obtaining pecuniary
9 gain, as opposed to other intents, such as improving or
10 liquidating a personal firearms collection: Provided, That
11 proof of profit shall not be required as to a person who
12 engages in the regular and repetitive purchase and disposi
13 tion of firearms for criminal purposes or terrorism

I saw that and immediately see where this can be used to crush someone in an instant. Let's say I am at a yard sale and the guy has two pistols, way under priced. I want one to keep and want the other to sell on to a guy I know looking for one. I sell it to him for market value making the one I want to keep free.... bam. Instant felon. Or, I buy 6 M1s from the CMP. I strip them for parts I need to correct/improve the M1s I already have. After parts swapping and trading out a couple from this batch with the ones I already have, I sell off 6 M1s at market rate, making a profit..... instant felon.

What makes this worse is there doesn't seem to be a provision for selling them on consignment through an FFL nor a time to hold limit. If I buy with the intent to ever sell, even 20 years from now and make a profit, I am a felon in the eyes of this law.

This is truly fucked.
