It's called the "sporter clause" and it's found within the 1968 GCA. It allows ATF to legislate by decree without congress if it determines a firearm of related item doesn't meets it's own qualifications for "sporting purposes" applications. It also permits them to create determination letters that in some cases are not even in compliance with their own stated definitions such as when their bumpstock ruling was not in accordance with their own definition of a "machine gun" or even a "firearm."MiamiOffshore wrote: ↑Tue Dec 22, 2020 5:24 pm
Does the G.C.A not REQUIRE a 90 day comment period? I don't understand how they are able to get away with making their own rules? Much like other things going on currently, rules are being changed on the fly to steer the outcome to a desired effect. The Constitution without the rule of law makes for a Nation founded on quicksand.
